Core Electronics – Terms of Service

1. About These Terms
These Terms of Service (“Terms”) apply when you (a) browse or use the website at https://core‑electronics.com.au (“Site”) or (b) purchase any product or service from Core Electronics Pty Ltd (“Core Electronics”, “we”, “us”, “our”). By accessing the Site, creating an account, or placing an order you agree to be bound by these Terms.
2. Definitions
“Account” means the profile you create on the Site;
“Business Day” means a day other than a weekend or public holiday in New South Wales;
“Consumer Guarantees” means the non‑excludable guarantees in the Australian Consumer Law (“ACL”);
“Order” means a request by you to buy one or more Products;
“Policies Page” means the page titled “Our Policies” at https://core‑electronics.com.au/policies‑faq;
“Privacy Policy” means our privacy policy at https://core‑electronics.com.au/privacy‑policy;
“Product” means any goods or digital content offered for sale on the Site.
3. Access and Use of the Site
1. We grant you a limited, revocable, non‑transferable licence to use the Site for personal, non‑commercial purposes in accordance with these Terms;
2. You must be at least 18 years old (or have parental/guardian consent) to place an Order;
3. We may suspend, restrict, or terminate your Account or access where we reasonably believe you have breached these Terms or the law.
4. Privacy
We collect, use, and disclose personal information as described in our Privacy Policy. By using the Services you consent to that collection and use.
5. Changes to the Site or Services
We may modify, suspend, or discontinue any part of the Site or Services at any time. For material changes to these Terms that adversely affect existing customers we will provide at least 30 days’ notice by email or notice on the Site.
6. Third‑Party Links
The Site may contain links to third‑party sites. We do not control, endorse, or accept responsibility for third‑party content or services.
7. Your Statutory Rights
Nothing in these Terms excludes, restricts, or modifies the Consumer Guarantees or any right you have under the ACL. If a Product fails to meet a Consumer Guarantee, you are entitled to the remedies provided by law.
8. Terms of Sale
(a) Order Acceptance – After you place an Order we will email an acknowledgement; a binding contract forms when we send a dispatch‑confirmation email (“Contract”). If we cannot accept your Order, we will notify you and refund any money paid.
(b) Pricing & Availability – Prices are in Australian dollars and include GST unless stated otherwise. If we discover a pricing error before dispatch we will ask whether you wish to proceed at the correct price or cancel. Delivery charges are shown at checkout.
(c) Payment – Your chosen payment method is charged when we accept the Order (or, for pre‑orders, as advised during checkout).
(d) Shipping, Risk & Title – Title passes when full payment is received; risk passes on delivery to your nominated address; dispatch/delivery dates are guides only and delays may occur, including force‑majeure events.
(e) Returns & Refunds – Our processes are set out on the Policies Page. You must follow those processes to obtain a remedy, to the extent permitted by law.
(f) Warranty – Manufacturer warranties (if any) are in addition to your statutory rights.
(g) Export, Resale & Drop‑Shipping – Products are supplied for use in Australia. You must not export, resell, or offer Products for drop‑shipping without our prior written consent and you must comply with all applicable export and sanctions laws.
9. Acceptable Use and Security
You must not commit unlawful acts, introduce malware, scrape data, crawl pages, or conduct penetration testing without our written consent, infringe IP or privacy rights, send spam, or act offensively or abusively. We use reasonable technical measures but cannot guarantee the Site is free from harmful code; you should use up‑to‑date antivirus software.
10. Intellectual Property
All content on the Site is owned by or licensed to Core Electronics. You may view, download, or print content for personal, non‑commercial use only. No other use is permitted without our written consent.
11. User‑Generated Content
If you post reviews, comments, or other content (“User Content”) you grant us a non‑exclusive, perpetual, worldwide, royalty‑free licence to use, reproduce, modify, and display that content in connection with the Services. You represent that you have the right to grant this licence and that your content is lawful.
12. Limitation of Liability
Except for liability that cannot be limited at law (including under the Consumer Guarantees, or for death or personal injury caused by our negligence): (a) our maximum aggregate liability arising from the Services or a Contract is the greater of AUD $100 or the amount you paid for the Product giving rise to the claim; and (b) we are not liable for indirect, consequential, or special loss, including loss of profit or data. The Site is provided “as is”; we do not warrant it will be uninterrupted or error‑free.
13. Indemnity
You agree to indemnify us (and our officers, employees, and agents) from losses we suffer because of your wilful or negligent breach of these Terms or your unlawful use of the Services. Your liability is limited to what is reasonably foreseeable.
14. Termination or Suspension
We may suspend or terminate your Account or access to the Services with reasonable notice if you breach these Terms and fail to remedy the breach (if capable of remedy) within 7 days of notice. Termination does not affect accrued rights.
15. Variation of Terms
We may amend these Terms by posting an updated version on the Site and, for material changes, giving at least 30 days’ notice. Continued use after the effective date constitutes acceptance.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales (and any consumer tribunal with jurisdiction under the ACL) have exclusive jurisdiction.
17. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remainder will remain in force.
18. Waiver
No failure or delay by us in exercising a right under these Terms operates as a waiver of that right.
19. Complaints & Contact
We aim to resolve issues quickly and fairly. Please contact us using the details on the Policies Page. If a dispute is not resolved you may have rights under the ACL to seek assistance from a consumer protection body or tribunal.
20. Entire Agreement
These Terms, the Policies Page, and any additional terms expressly referred to in them constitute the entire agreement between you and us and supersede all prior discussions.
